Volume V presents a selection of cases in the state and federal courts with a view to providing a more detailed and systematic reconstruction of Marshall's practice than is possible within the confines of a strict chronological format. It draws on a body of legal papers that were not published in the earlier volumes but were either calendared or listed at their respective dates. It serves at once as a conclusion to the documentary records of his early career and as an introduction to the volumes that will chronicle the Supreme Court years.

Many of the documents presented in this volume came from the Library of Virginia, Richmond, the depository for the records and papers of the federal circuit court in which Marshall practiced. That institution also maintains an outstanding collection of county court records on microfilm that were used in researching Marshall's cases.
